THE CONSTITUTION OF THE ST. JOHN'S REGATTA COMMITTEE HALL OF FAME

ARTICLE 1 NAME: The Royal St. John's Regatta Hall of Fame
ARTICLE 2 LOCATION: St. John's, Capital City of the Province of Newfoundland
ARTICLE 3 OBJECTS:
1. To recognize, honour and pay tribute to individuals or crews on the basis of ability, sportsmanship, character and achievement or extra-ordinary distinction in fixed seat rowing, whether amateur or professional.
2. To recognize, honour and pay tribute to those individuals, groups or associations who have given distinguished service and who have made a major contribution to the development and advancement of fixed seat rowing in Newfoundland.
3. To encourage the development of all aspects of fixed seat rowing by permanently recording the achievements and history of such individuals, groups, associations, or crews.
ARTICLE 4 ADMINISTRATION:
The affairs of the St. John's Regatta Committee Hall of Fame shall be administered by a Board of Governors.
ARTICLE 5 BOARD OF GOVERNORS:
1. The Board of Governors shall consist of six (6) members, one of whom shall be designate its Chairman and Secretary.
2. The Directors of the St. John's Regatta Committee shall appoint the Board of Governors and designate its Chairman and Secretary.
3. Each member of the Board of Governors shall be appointed for a term of three (3) years. The term of a member of the Board of Governors shall expired at midnight on November 30th of the year indicated either at the time of his/her appointment or as set out in clauses (a) to (b) below. A member of the Board of Governors shall hold office until his/her successor is appointed.
  - (a) The following named persons shall be deemed to have been validly appointed to the Board of Governors for a term expiring at midnight on the date set opposite his/her name, namely:
    - Thomas Stone - November 30, 1991
    - Bernard (fanny) Collins - November 30, 1 991
    - Alec. G. Henley - November 30,1992 -
    - James Fagan - November 30, 1992
    - Frank Graham - November 30, 1993
    - John O'Mara - November 30,1993
  - (b) On the expiry of the appointment of those members of the Board of Governors set out in Sub-Paragraph (a) hereof, each member of the Board of Governors thereafter shall be appointed for a term of three years. The term of a member of the Board of Governors shall expire at midnight on November 30, of the year indicated at the time of his/her appointment. A member of the Board of Governors shall hold office until his/her successor is appointed.
4. A person may serve as a member of the Board of Governors for no more than two (2) consecutive terms, but is eligible to serve in such capacity again after an absence from such membership of one or more years.
5. The first members of the Board of Governors shall be appointed as follows, that is to say, two (2) members appointed for a three (3) year term; two (2) members appointed for a two (2) year term; and two (2) members appointed for a one (1) year term.
6. The quorum for any meeting of the Board of Governors shall be four (4).
7. There shall be no voting by proxy.
8. The Chairman will preside at all meetings of the Board of Governors but in the absence of the Chairman, a Chairman shall be elected for the purpose of that meeting.
9. At all meetings of the Board of Governors, other than at the joint meeting with the Selection Committee for the purpose of holding the election to the Hall of Fame, as hereinafter mentioned, the Chairman, in the event of a tie vote. shall have a second and casting vote.
10. Each meeting shall determine its own procedure; however, where possible, parliamentary procedure shall be followed.
11. In the event of the death or resignation of a member of the Board of Governors, the Directors of the St. John's Regatta Committee shall forthwith, fill the vacancy and the individual so appointed shall complete the term of his predecessor.
ARTICLE 6 DUTIES OF BOARD OF GOVERNORS:
1. The Board of Governors shall be the trustees of the possessions and records of the St. John's Regatta Committee Hall of Fame;
2. The Board of Governors shall be responsible for the administration of all of the affairs of the St. John's Regatta Committee Hall of Fame;
3. The Board of Governors are authorized and empowered to pass rules, regulations and generally to established the procedure for the general administration of the affairs of the St. John's Regatta Committee Hall of Fame;
4. The Board of Governors shall appoint the Selection Committee hereinafter mentioned.
ARTICLE 7 FINANCES:
The cost of establishing and maintaining the St. John's Regatta Committee Hall of Fame shall be paid by the St. John's Regatta Committee provided that the Directors of the St. John's Regatta Committee shall have given prior written approval thereof.
ARTICLE 8 CLASSIFICATION OF MEMBERS:
There shall be three (3) categories of membership and enrolment in the St. John's Regatta Committee Hall of Fame, namely:
1. Rowers/Crews
2. Coxswains/Coaches
3. Builders
"Rower" is defined as an individual competitor or participant who has participated in the Annual St. John's Regatta.
"Crew" is defined as any group, association, family or team which has competed or participated in the Annual St. John's Regatta and which includes where appropriate, a Coxswain and/or a Coach.
"Coxswain"/"Coach" is defined as an individual who has combined competition or participation in fixed seat rowing, (either as a rower or a crew member in the Annual St. John's Regatta), with continued interest in and contribution to the promotion, development and advancement of the Annual St. John's Regatta, and, without restricting the generality of the foregoing, may include managers, trainers and physical fitness instructors.
"Builder" is defined as any individual, group, association or family which has made a major contribution to the promotion, development and advancement of the Annual St. John's Regatta and, without restricting the generality of the foregoing, may include Committee Members, officials, benefactors, sponsors, administrations and executives of athletic clubs, groups or associations.
ARTICLE 9 SELECTION COMMITTEE:
1. The Board of Governors shall appoint a Selection Committee consisting of six (6) members who are knowledgeable in the history, traditions, accomplishments, ability, skill, achievements and contribution of Rowers/Crews. Coxswains/Coaches, and Builders in Newfoundland, and whose prestige, judgement and integrity are most likely to ensure a fair and impartial assessment of the qualities of the candidates submitted for this consideration and to ensure the maintenance of a very high standard of excellence in the selections made by them;
2. The Board of Governors shall appoint the Selection Committee, as aforesaid, and designate its Chairman and Secretary.
3. Each member of the Selection Committee shall be appointed for a term of three (3) years. The term of a member of the Selection Committee shall expire at midnight December 5th of the year indicated either at the time of his/her appointment or as set out in clauses (a) to (f) below. A member of the Selection Committee shall hold office until his/her successor is appointed.
  Notwithstanding any previous appointments to the Selection Committee as of December 15, 1991, the following shall be deemed to have been validly appointed to the Selection Committee for a term expiring at midnight on the date set opposite his name, namely:
  (a) The following named persons shall be deemed to have been validly appointed to the Selection Committee for a term expiring at midnight on the date set opposite his/her name, namely:
  - Gert Reardigan- December 15, 1991
  - Gail Malone - December 15, 1991
  - Geoffrey C. Carnell - December 15, 1992
  - Jack Reardigan - December 15, 1992
  - Gerry Malone - December 15, 1993
  - Mr. Justice Gerald F. Lang - December 15,1993
  (b) On the expiry of the appointment of those members of the Selection Committee set out in Sub-Paragraph (a) hereof, each member of the Selection Committee thereafter shall be appointed for a term of three (3) years. The term of a member of the Selection Committee shall expire at midnight on December 15, of the year indicated at the time of his/her appointment. A member of the Selection Committee shall hold office until his/her successor is appointed.
4. A person may serve as a member of the Selection Committee for no more than two (2) consecutive terms, but is eligible to serve in such capacity again after an absence from such membership of one or more Years;
5. The first members of the Selection Committee shall be appointed as follows, that is to say, two (2) members appointed for a three (3) year term; two (2) members appointed for a two (2) year term; and two (2) members appointed for a one (1) year term;
6. The quorum for any meeting of the Selection Committee shall be four (4);

9. At all meetings of the Selection Committee, other than at the joint meeting with the Board of Governors for purposes of holding the election to the Hall of Fame, as hereinafter mentioned, the Chairman in the event of a tie vote, shall have a second and castinq vote;
10. Each meeting shall determine its own procedure; however, wherever possible, proper parliamentary procedure will be followed;
11. In the event of the death or resignation of a member of the Selection Committee, the Board of Governors shall forthwith, fill the vacancy and the individual so appointed shall complete the term of his predecessor.
ARTICLE 1O ELIGIBILITY FOR ELECTION:
1. Rower/Crew Candidates shall be chosen on the basis of their fixed seat rowing ability, sportsmanship, character and achievement of extra-ordinary distinction in amateur or Professional fixed seat rowing;
2. Coxswain/Coach Candidates shall be chosen on the basis of ability, sportsmanship, character and achievement of extra-ordinary distinction in amateur or professional fixed seat rowing and contribution to the promotion, development and advancement of fixed seat rowing in Newfoundland;
3. Builder Candidates shall be chosen on the basis of having made a major contribution to the promotion, development and advancement of fixed seat rowing in
4. No individual, group, association, family or team, shall be eligible for election to the St. John's Regatta Committee Hall of Fame as a Rower, Crew, Coxswain or Coach until a period of three (3) years has elapsed from the date of his, their or its retirement from active competition unless the Board of Governors and the Selection Committee in joint meeting feel, in their absolute discretion, that special considerations and conditions exist to merit reduction of the period aforementioned.
5. Members of the Board of Governors and of the Selection Committee shall not be eligible for election to the St. John's Regatta Committee Hall of Fame while serving in office.
6. Any individual, participant, group, association, family or team now or in the future enroled in the Canadian or Newfoundland Sports Hall of Fame whose major achievement was in keeping with at least one of the three (3) categories of membership and enrolment in the St. John's Regatta Committee Hall of Fame as set out in Article 8 herein shall be deemed a member of the St. John's Regatta Committee Hall of Fame and shall be so enroled.
ARTICLE 11 ELECTION OF POSTHUMOUS:
1. Any person who shall die between the date of his election to the St. John's Regatta Committee Hall of Fame and the date of the enrolment ceremony shall be duly enroled posthumously.
2. A deceased person may be a candidate for election to the St. John's Regatta Committee Hall of Fame and if so elected be enroled posthumously.
3. At any induction ceremony held for the purpose of enrolment into the St. John's Regatta Committee Hall of Fame, a deceased person, so elected, shall be represented by an individual selected by the Board of Governors.
ARTICLE 12 PROCEDURE FOR NOMINATION AND ELECTION:
1. (1) Each individual member of the Board of Governors and the Selection Committee may make up to six (6) nominations provided each nominator shall not nominate more than three (3) nominees from any one (1) of the following Categories:
  Category 1) Rowers/Crews;
  Category 2) Coxswains/Coaches;
  Category 3) Builders.
2. (2) Any group or individual shall have the right to submit an unlimited number of nominations in each of the following Categories:
  Category 1) Rowers/Crews;
  Category 2) Coxswains/Coaches;
  Category 3) Builders.
3. (3) All nominations shall be made in writing to the Selection Committee and shall contain the fullest possible information, dates and records of the merits of each;
4. (4) The form of the nomination shall be prescribed by the Selection Committee and all nominations submitted shall be in accordance with the required form;
5. (5) Once in every calendar year the Selection Committee shall set a date for the receipt of nominations and shall cause same to be advertised at least once in the daily newspaper in circulation in St. John's. All nominations shall be in the hands of the Secretary of the Selection Committee on or before the nomination date set. Nomination forms not in the hands of the Secretary of the Selection Committee by the date set for the receipt of nomination shall be deemed to be null and void and shall not be considered by the Selection Committee the next year unless again submitted in accordance with these rules.
6. (6) The Secretary of the Selection Committee shall, as soon as practical, in each and every year, mail to each member of the Selection Committee a copy of each nomination received together with all supporting material and the names of their respective nominators;
7. (7) If the Selection Committee is not satisfied with the information contained in the nomination form and with the supporting material, it shall request the nominator to supply such additional information and facts as it deems necessary;
8. (8) The Selection Committee shall hold its meeting or meetings in each and every year and it shall be the duty of the Selection Committee to reduce the number of nominees to five (5), provided however, that the number of nominees may be less than five (5) if in the discretion of the Selection Committee, a nominee is not worthy of further consideration for the election to the St. John's Regatta Committee Hall of Fame; (Provided however that in the first year the number of nominees shall be ten (10));
  The reduction in the number of nominees to five (5) shall be accomplished in the following manner:
  1. Each member of the selection committee shall assign a specific number of points to each nominee out of a maximum 100 points per nominee.
  2. The five nominees receiving the most points shall be the successful nominees.
  3. In the event that there is a tie for the fifth and final nominee, each member of the Selection Committee shall assign a specific number of points out of a maximum 100 points to each of the tied nominees so as to reduce the number of nominees to five (5).
  4. Any nominee whose nomination shall have been considered by the Selection Committee for five consecutive years without that nominee being elected to the Hall of Fame, shall not thereafter be reconsidered for nomination unless and until additional information supporting the said nomination shall be lodged with the Secretary of the Selection Committee;
9. (9) Immediately following the meeting of the Selection Committee at which the number of nominees is reduced to five (5) or less, as aforesaid, (to be ten (10) in the first year only), the Secretary of the Selection Committee shall forward to all members of the Board of Governors the nomination forms together with all data, facts, information and records of the candidates for election to the St. John's Regatta Committee Hall of Fame;
10. (1O) The power of election of all candidates to the St. John's Regatta Committee Hall of Fame is vested in the Board of Governors and the Selection Committee at a joint meeting which shall take place once a year.
11. (11) The Chairman of the joint meeting shall be the Chairman of the Board of Governors but in his absence shall be the Chairman of the Selection Committee.
12. (12) All members of the Board of Governors and the Selection Committee shall receive not less than two (2) weeks notice of the joint meeting convened for the purpose of the election of candidates to the St. John's Regatta Committee Hall of Fame. Individual members of the Board of Governors and the Selection Committee may waive such notice.
13. (13) The quorum of the joint meeting convened for the purpose of the election of candidates to the St. John's Regatta Committee Hall of Fame shall not be less than seven (7) and there shall be present and voting out of the quorum not less than three (3) members of the Board of Governors and not less than three (3) members of the Selection Committee.
14. (14) BALLOTING :
  (a) Secret Ballot shall be used and each member shall be entitled to vote for the number of candidates established by the quota, aforesaid.
  (a.1) The Chairman shall make a declaration of the ballot results after each ballot is cast and counted.
  (b) Any candidate receiving unanimous approval of all present and voting shall be declared elected.
  (c) If all of the quota is not elected, then a series of run-off ballots shall be conducted with each member present entitled to vote for the number of candidates remaining to be elected under the quota aforesaid, and each unanimous choice of those present shall be elected.
  (d) If on any ballot there is a candidate(s) gaining unanimous approval, then the next ballot immediately following that ballot, will include the names of all remaining candidates, including the candidate with the lowest number of votes on the ballot containing the candidate(s) with unanimous approval. A candidate receiving no votes on any ballot shall not be considered on any subsequent ballot.
  (e) If on any successive ballot there is no unanimous selection then the candidate(s) receiving the highest number of votes (provided that it is not less than fifty (50%) percent of the total membership of the joint meeting present and voting) shall be declared elected. Balloting shall continue in this manner until the quota is filled or until (f) below becomes operative.
  (f) If on any successive ballots no candidate receives fifty per cent (50%) of the votes of the total membership of the joint committee present and voting, the candidate (in the case of a tie, the candidates) with the least number of votes on the last ballot shall be dropped and one additional ballot shall be conducted and the candidate receiving the highest number of votes (provided it is not less than fifty per cent (50%) of the total membership of the joint committee present and voting) shall be declared elected. No further balloting shall be conducted regardless of whether the quota has been filled or not.
15. ARTICLE 13 PUBLICATION OF ELECTION:
  1. (1) The Chairman of the Board of Governors or in his absence the Chairman of the Selection Committee, as appropriate, shall prepare a release, in writing, of the election results when final, for general publication. The release shall only make reference to the candidates elected and shall make no reference to the candidates not elected or in any way indicate the results of any ballot or balloting.
  2. (2) When a candidate is elected to the St. John's Regatta Committee Hall of Fame, as duly certified by the Chairman of the joint meeting, the candidate so elected, if living, shall be notified in writing of his, their or its election as soon as possible. In the event of a posthumous election, the joint meeting of the Board of Governors and the Selection Committee shall determine to whom notice of election shall be given.
16. ARTICLE 14 PROCEDURE OF enrolment:
  1. (1) Each newly elected member of the St. John's Regatta Committee Hall of Fame (or proxy if said

      member is unavoidably absent) may be formally inducted into membership into the
      St. John's Regatta Committee Hall of Fame at an official induction ceremony.
 (2) The time and place of such ceremony shall be as agreed upon between the Board of Governors and
      the Directors of the St. John's Regatta Committee.
 (3) At the time of induction, the new member shall receive appropriate insignias of membership; a
      certificate of membership and such other forms of recognition as the Board of
      Governors deem appropriate.
 (4) The Board of Governors shall be responsible for establishing and maintaining a permanent roll of
      members elected to the St. John's Regatta Committee Hall of Fame, said roll to
      contain such information and

17. ARTICLE 15 PROCEEDINGS CONFIDENTIAL:
  Except as hereinbefore expressly provided, no member of the Board of Governors or of the Selection Committee shall at any time divulge or disclose the results or other particulars of the balloting, nor shall he disclose the vote of any member at any time, nor shall he disclose the names of those considered for election to the Hall of Fame.
18. ARTICLE 16 AMENDMENTS:
  No repeal or amendment of this Constitution shall be made except at a General Meeting of the St. John's Regatta Committee, and unless notice of such proposal, repeal or amendment has been given to the Directors of the St. John's Regatta Committee in writing, and:
  1. Read to the Committee at the General Meeting immediately prior to the Meeting at which the proposed amendment is to be considered; or
  2. Notice thereof is mailed to ordinary members at least twenty-one (21) days prior to the meeting at which the proposed amendment is to be considered; And only ordinary members of the St. John's Regatta Committee may propose any such repeal or amendment.
19. ARTICLE 17 RECTIFICATION OF IRREGULARITIES:
  1. (1) The directors of the St. John's Regatta Committee may, upon due consideration, ratify and confirm the appointment of any persons to the St. John's Regatta Committee Hall of Fame Board of Governors or the Selection Committee of the St. John's Regatta Committee Hall of Fame whose appointment thereto may have been attended by irregularities and the said appointments shall be effective from the date or dates stipulated by the said Directors and thereafter any such irregularity shall be conclusively deemed to have been rectified.
  2. (2) The Directors of the St. John's Regatta Committee may, upon due consideration, ratify and confirm the election and enrolment of any Rower/Crew, Coxswain/Coach or Builder Candidate to the St. John's Regatta Committee Hall of Fame whose election and enrolment may have been attended by irregularities and the said election and enrolment shall be effective from the date or dates stipulated by the said directors and thereafter any such irregularity shall be conclusively deemed to have been rectified.
  3. (3) This Article 17 shall be void and of no further effect as of mid-night, January 31, 1994.
